Claim
forms will be rejected and your claim package returned at your expense due to
failure to comply with shipping instructions. JTV will not assume the
responsibility to mix and match your stones to your receipts.
Class counsel offers the following
suggestions with regard to completing the claim form, packaging and shipping:
1. Follow the instructions on the claim form precisely. Read the claim form and then reread it to be sure you understand the instructions. If you need help, ask a friend or family member to assist you or contact Class Counsel if you need assistance. Read all the information contained on this page as well.
2.
Understand
that your claim package will be rejected and returned to you if your loose
gemstones are not packaged separately and do not include sufficient proof of
purchase with each separately packaged gemstone.
3.
The labels on the bottom of the gem jars are not sufficient proof
of purchase.
4.
Proof of purchase must show the following (1) item description (2)
purchase price and (3) that the item was purchased from JTV.
5.
You may obtain proof of purchase from JTV for a fee.
We are not able to get this fee waived for you.
6.
If you have already mailed your claim package and did not individually
package your loose gemstones, your claim package will be rejected and returned
to you. Be on the lookout for the
return package and know that you must get it repackaged per the instructions on
the claim form and postmark it by April 20, 2009 for your claim to be
considered.
7.
The deadline to file a claim is April 20, 2009.
ALL CLAIM FORMS MUST BE POSTMARKED BY APRIL 20, 2009.
8. You will only submit ONE CLAIM FORM. If you need additional space, use additional sheets of paper. We suggest you use the forms below (or similar forms) if you need additional space. Do not use more than one claim form.

You
will
return loose gemstones with
the claim form. Put one loose gemstone in a ziplock back with the
matching receipt/proof of purchase and seal the bag. Write your
name and phone number on the outside of the ziplock bag. Do this for all
your loose gemstones and list these under “Loose Gemstones” in Section C.
Then put the individual bags in a large envelope or box with the completed claim
form. Do not seal your package
until after you pay for shipping and add your shipping charges to the claim
form. If you need additional space
to list your loose gemstones, we suggest you use the form above or a similar
form and attach to the claim form.
10.
If you purchased Jewelry or other products (i.e. parcels) containing
andesine-labradorite, you will list these items on the claim form under
“Jewelry and Other Products” in Section C.
You must attach your proof of purchase for the jewelry and parcels to the
back of the claim form. However,
you do not return your jewelry or parcels.
Again, if you need additional space on the claim form, use additional
sheets of paper. We suggest you use
the form above or a similar form and attach to the claim form.
11.
Remember, you will submit only ONE claim form.
12.
Remember, you will package your loose gemstones separately and put them
in one box for return. Do not seal
your package until after you pay for your shipping.

13.
Remember, you do not return jewelry or parcels but you do list
them on the claim form and attach proof of purchase for the jewelry items and
parcels.
14.
You do return loose gemstones.
See paragraph 9 above.
15.
When you take your package to ship, have the counter person provide you
with two receipts. Before you seal
your package, write the amount of shipping on the claim form in the space
provided for this and add the cost for shipping to get a TOTAL CLAIM AMOUNT. Attach one shipping receipt to the claim form and keep a copy
of the shipping receipt for your records. You
should also keep a copy of the claim form for your records as well.
16.
Remember, there is no guarantee that you will get a full cash refund for
your loose gemstones, so read the benefit options listed on the claim form
carefully and select the one that bests suits you. The settlement
documents can be read or downloaded at www.andesineclassaction.com.
17.
Remember, if you are satisfied with your andesine-labradorite loose
gemstones and/or believe they have a certain value to you, you DO NOT
have to make a claim under this settlement.
18. If you had your gemstones appraised and are happy with your appraisal (or even if you are not), you can keep your gemstones. There is no requirement that you send in your stones.
19. Your proof of purchase does not have to be an original receipt and/or invoice it can be a photocopy. However it must be sufficient proof of purchase. Refer to the claim form regarding what constitutes sufficient proof of purchase.
